A LUNG transplant patient was found with more than €500 worth of cannabis after gardai raided his south Dublin home, a court heard.
Fred Rumling (46) is awaiting a lung transplant operation and currently needs an oxygen tank to help him breathe.
Judge Deirdre Gearty said given the circumstances, she would apply the probation act.
The defendant, of Mountainview Drive in Rathfarnham, admitted before Dun Laoghaire District Court to possession of cannabis.
The offence took place at his home in Rathfarnham on January 12, 2012.
Garda Liam Healy said he obtained a search warrant and searched the defendant’s home.
During the course of the search, cannabis with a street value of €500 was found.
Gda Healy said Rumling co-operated with gardai and took full responsibility.
The court heard that Rumling has four previous convictions, but they date back more than 20 years.
Defence solicitor Ronnie Lynam said Rumling suffers a number of ailments and a lung transplant is his only hope if he is to have any quality of life.
Mr Lynam said the defendant has four children and he has been out of work for the last eight years.
The solicitor said Rumling’s days of using cannabis are well over, as his consultant would not be happy about it.
Mr Lynam said Rumling is lucky to even be here today, as he was seriously ill in 2013 and spent some time in hospital.
He asked the judge to be as lenient as possible, saying the incident was over two years ago and Rumling has “a lot on his plate”.
Judge Gearty wished Rumling all the best with his treatment, and said that given the exceptional circumstances of the case she would apply the probation act.
